Review of Variance Request from Mashpee Cesspool Regulation – 71 Hooppoole Road, Jean <br />Faxon Cornish. <br /> <br />Mr. Seabury noted: t he owner, Jean Faxon Cornish, has submitted a request for a variance to sell <br />the property at 71 Hooppole without upgrading the existing cesspools in lieu of the requirements <br />of the Cesspool Regulation. The buyer was contacted to attend the public meeting to discuss the <br />conditions of the enforceable agreement that will mitigate the variance – the system would be <br />th <br />installed by May 15, 2024. <br /> <br />Mr. Raposa made a motion to approve the variance with the condition that the buyer enter into an <br />th <br />enforceable agreement to install the system by May 15, 2024, which was seconded by Mr. <br />Virgilio. <br /> <br />Mr. Raposa (Yes), Mr. Virgilio (Yes) – Motion passed unanimously. <br /> <br />Review of Request for Title V Variance for 138 Summersea Road – Glen Harrington, A Perfect <br />Environment. <br /> <br />Mr. Seabury noted: The proposed design plan includes a 1,500 gallon septic with the Fast .75 <br />with UV light in the 1,000 Gallon pump chamber, followed by a H-20 D-Box ending with the 2 <br />H-20 500 gallon Leaching Chambers. The variance request are as follows: <br /> <br />1) 310 CMR 15.405(1)(a) - Request a 4.5' variance, SAS to property line, for a 6.5' setback. <br />2) 310 CMR 15.405(1)(f) - Request a 21.4' variance, pump chamber to coastal bank, for a <br />3.6' setback. <br />3) 310 CMR 15.405(1)(f) - Request a 25' variance, Fast tank to coastal bank, for a 0' <br />setback. <br />4) 310 CMR 15.405(1)(b) - Request a 4' variance, SAS to cellar wall, for a 16' setback. <br />5) 310 CMR 15.405(1)(g) - Request a 3' variance from the SAS to the Water line from the <br />required 10’ <br />6) Mashpee Board of Health Regulation IX Sec. 11.00(d) – Variance of 106’ from the <br />required 150’ requirement of the SAS from the coastal bank. <br /> <br />Mr. Seabury noted that the plan is the maximal feasible compliance: small lot, close to the water, <br />and best available technology to protect the environment. Mr. Virgilio concurred. <br /> <br />Mr. Raposa made a motion to approve the variance as presented, which was seconded by Mr. <br />Virgilio. <br /> <br />Mr. Raposa (Yes), Mr. Virgilio (Yes) – Motion passed unanimously. <br /> <br />Updates to Tobacco Regulation – Sarah McColgan, Tobacco Control Director: Massachusetts <br />Health Officer’s Association <br /> <br />Mr. Seabury noted there are recommendations, and this is an introduction to the new <br />Commonwealth Law. Mr. Seabury confirmed the Town had received a sample from Bob Collett, <br />Cape Cod Regional Tobacco Control Program, for proposed Town regulations. Mr. Seabury <br />suggested going over the Commonwealth changes first and then the recommendations. Ms. <br /> <br />
