Health Agent <br />Chair Baumgaertal called the November 3, 2022 Board of Health meeting to order at 6:00 PM. <br />OLD BUSINESS: <br />1. COVID update <br />No major update with Covid per Mr. Seabury. <br />NEW BUSINESS: <br />1. Review and approval of meeting minutes for June 16, 2022 & June 30, 2022 Regular <br />session <br />The minutes for the June 16, 2022 and June 30th, 2022 meetings were unanimously <br />approved with Ernest Virgilio making the motion to accept the minutes as provided with <br />Brian Baumgaertal seconding. Roll Call Vote: Ernest Virgilio (yes), Brian Baumgaertel (yes) <br />VOTE: unanimous (2-0) <br />2. Review and approval of Expense Warrants <br />Mr. Seabury reviewed two warrants - MHOA Conference and VNA of Cape Cod. One of <br />the MHOA Conferences our Assistant Health Agent was not able to attend and we will be <br />getting reimbursed for $500. The Warrants were reviewed and approved with Members <br />signing the warrants presented by Mr. Seabury. <br />3. Appeal of Tobacco Violation at Mashpee Country Store Mr. Seabury commented On <br />September 20, 2022, a tobacco compliance check was conducted at the above -referenced <br />establishment by the Cape Cod Regional Tobacco Control Program. During the compliance <br />check, Black & Mild cigarillos/little cigars/blunts were sold to a minor. The sale of tobacco <br />products to an individual under the minimum legal sales age of 21 is a violation of M.G.L. <br />c.270, §6(b); 105 CMR 665.010(A); and the Mashpee Board of Health "Smoking <br />Regulation", Part XIII, §§ 1(D)(1) & (3). Per 105 CMR 665.045(A)(1), in the case of a ill <br />violation, a fine of $1,000 shall be imposed. <br />
