MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />OCTOBER 11, 2023 <br />Mr. Morris wanted to know how the raised patio area could justify a new structure. Attorney <br />Kirrane said that it is just a disturbed area. <br />The Board had a discussion regarding the existing setback of the house being 3.3 ft. which is non- <br />conforming, but the area that will be built will be setback 0.7 ft. from the side line. <br />Chairman Bonvie polled the Board and all members voiced their concerns with the "0.7 ft." setback <br />portion of the project. Mr. Goldstein asked Mr. Morris a building question if he allows a second <br />floor addition added to a cinder block foundation. Mr. Morris stated that he would require a <br />structural engineer to provide a letter of approval. <br />Chairman Bonvie asked for public comments. <br />Mr. Doug Semple of 43 Sakonnet Drive spoke in favor of the project. Mr. Garry Briggs of 51 <br />Massasoit Avenue spoke in favor of the project. <br />Attorney Kirrane had three points for the Board to consider. First, the neighbors are in favor of the <br />project that will be most impacted by the change. Second, a 2 ft. cantilever would be allowed and <br />does not count toward setback. Third, the existing lot is odd shaped, there's two roads, and it's <br />more than 17 ft. from the road. <br />Ms. Sangeleer stated that her concern was not a zoning issue, but a building issue, she was <br />concerned if a structural engineer did not approve the existing foundation, the applicant might <br />require a raze and replace. <br />Chairman Bonvie polled the Board for their opinion and all were concerned with the "0.7 ft." <br />setback. Mr. Blaisdell stated his opinion that the Board has to set a precedent for other applicants. <br />Attorney Kirrane asked the Board for an extension until October 25, 2023 hearings. <br />Mr. Goldstein made a motion to accept Attorney Kirrane's request for extension until October 25, <br />2023. Ms. Sangeleer second. All were in favor. <br />OTHER BUSINESS <br />Approve Meeting Minutes dated September 27, 2023. <br />Ms. Sangeleer made a motion to approve the meeting minutes. Mr. Ganzenmuller second. All <br />were in favor. <br />
