Mr. Harrington <br /> challenges the fact that the Fronto King that was used a violation back in April of 2019 is <br /> exactly the same as the Grabba Empire product that was brought to us and cited as the <br /> violation. <br /> Mr. Baumgaertel stated, it's difficult to get a sense because looking at the package that <br /> Attorney Mills displayed, it clearly indicates that it is a cigar. Mr. Mills also mentioned <br /> that the product can't be pulled apart that it is glued together, but Mr. Harrington is <br /> saying that the product is soft. Does Grabba sell multiple products, it there a potential <br /> for confusion there? Is it a cigar or is it a wrap. <br /> Mr. Harrington suggested gettin a sample of the product to the board and the board <br /> members can stop by the office to get a look at it before they make their determination. <br /> It is difficult to show on a remote basis. Once the board members see what was originally <br /> issued before as the Fronto Cigar which is loosely rolled leaves is the exact same product <br /> as the Grabba Empire which was cited on this occasion. <br /> Mr. Java spoke about multiple conversations and correspondence that he had with the <br /> BOH telling him what he can sell and cannot sell. <br /> Mr. Harrington wanted to make sure there is clarification on the line of communications. <br /> Mr. Harrington thought it would beneficial to members of the board, because they <br /> haven't been here through the other violations, that would spell out what conversations <br /> were had at what time and the emails that go along with those conversation so we can <br /> get a better sense of what the timeline is. Mr. Harrington believed that confusion over <br /> the definition of some of these products contributed to what's going on here. If Mr. Java <br /> was told and there is some sort of evidence of those communication,emails or something, <br /> so that we can see those things. If Mr.Java was told that those products were ok at some <br /> point and now that they're not,the health department wants to get some sort of evidence <br /> to that effect so that we're not just talking back and forth. We're going back to 2019 on <br /> some of this so I want make sure that we're all on the same page. Mr. Harrington would <br /> also like to give the board members and opportunity to make an objective assessment of <br /> the product in question. There is some subjectivity in the way that the regulation is <br /> worded that Mr. Harrington never appreciated and was hesitant to list any specific <br /> products in the regulation because when a new product comes along unless we're able <br /> to continuously adapt our regulations to new products coming down the line, it's <br /> impossible to have them all caught up. Two things I would like to propose: <br /> 1 We take a look at some of the facts about the communications that have <br /> occurred in relation to this and <br /> 2 Give the board members an opportunity to make an objective assessment <br /> of the products for themselves to make a determination on whether this <br /> particular product would be a leaf or a cigar. <br /> Before we make any kind of decision, Mr. Harrington didn't feel that enough information <br /> is given to make any kind of decision tonight and would like to give the board members <br /> an opportunity to respond to what they heard tonight. <br />
