MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 8, 2023 <br /> 61 Shoestrin Ba Road: Petitioner, 61 Shoestring Bay Road, LLC requests a Variance under <br /> §174-33 of the Zoning Bylaws (Setback from wetlands) to allow for construction of a new single <br /> family dwelling and attached garage on property located in an R-3 Zoning District, (Willowbend <br /> Development), Map 84 Parcel 35, Mashpee, MA. (Continued from October 11, 2023 hearings). <br /> Mr. Reidy read a letter into the record regarding 61 Shoestring Bay Road dated November 6,2023 <br /> from Attorney Christopher Kirrane requesting to withdraw a Variance request without prejudice <br /> as the project has not been approved by the Conservation Commission. <br /> Mr. Reidy made a motion that the Board accept Attorney Kirrane's request for withdrawal of 61 <br /> Shoestring Bay Rd without prejudice. Mr. Blaisdell second. All were in favor. <br /> 66 Massasoit Avenue: Owners, Patrick M. and Sharon M. O'Connor request a Written Finding <br /> under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of a second story <br /> addition, alteration, and extension to a pre-existing, non-conforming structure on property located <br /> in an R-3 Zoning District, Map 72 Parcel 30, Mashpee, MA. (Continued from October 11, 2023 <br /> hearings). <br /> Attorney Christopher Kirrane representing the homeowners for a Written Finding request located <br /> at 66 Massasoit Avenue. Also present was Mr. O'Connor, homeowner. At the last hearing, the <br /> Board was concerned with the original plan of the addition that depicted a setback of.7", where <br /> the existing nonconformity depicted 3.3 ft. on Massasoit Ave. The Board noted that this would <br /> have increased the existing nonconformity. The plans were revised, and the setback was improved <br /> at 3.5 ft. as proposed. <br /> Mr. Furbush asked Mr. Morris if he had any issues with the cantilever of the addition. Mr. Morris <br /> said no. <br /> Ms. Sangeleer asked if dry wells were being installed to capture the roof run off.Attorney Kirrane <br /> reviewed the site plan, and there were no drywells depicted on the plan, but the Board could <br /> condition that request if approved. <br /> Mr. Goldstein asked if Conservation requested drywells. Attorney Kirrane they did not. <br /> Mr. Reidy read the Conservation Department comments dated November 2, 2023; "The <br /> Commission approved an RDA permit application at their 711312023 meeting". The Board of <br /> Health comments dated November 2, 2023; "To remain a 2 bedroom in a Zone IZ No comment. " <br /> There were no other comments from the Board or audience. <br /> Ms. Sangeleer asked for a motion to close public comments. Mr. Furbush made a motion to close <br /> the public comments. Mr. Blaisdell, second. All were in favor to close public comments. <br /> 3 <br />
