Gould and Bk: 30751 <br /> Jo Robin Gould Pg.: 49 <br /> 38 Fells Pond Road <br /> (Map 106 Parcel 34) <br /> Mashpee,MA 02649 <br /> A Petition was filed on February 16, 2023 by Owners, Michael E. Gould and Jo Robin Gould <br /> request a Written Finding under§174-17 of the Zoning Bylaws to allow for an addition, extension <br /> of a pre-existing, non-conforming dwelling on property located in an R-3 Zoning District, at 38 <br /> Fells Pond Road,Map 116 Parcel 22, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on March 3, 2023 and March 10, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the request for a Written Finding on Wednesday, March 22, 2023 <br /> at which time the following members of the Board of Appeals were present; Chairman Jonathan <br /> Furbush, Board Members, Ron Bonvie, Scott Goldstein, Jim Gould, and Associate Member, <br /> Robert Caggiano. The Board heard testimony from the applicant, and extended the hearing until <br /> May 24,2023 to allow time for the applicant to revise the site plan as requested by the Board. The <br /> Board thereafter accepted another continuance until June 14, 2023 for the applicant to further <br /> revise the site plan and building plans. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,June 14,2023 <br /> at which time the following members of the Board of Appeals were present; Chairman, Jonathan <br /> Furbush, Vice Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and <br /> Associate Member, Sharon Sangeleer. <br /> Ms. Jo Robin Gould, homeowner provided the Board with a narrative of the Written Finding <br /> request. The original project did not conform to the allowed percentage of lot coverage at 28.9%. <br /> The Architect revised the building plan and reduced the proposed addition to 380 sq. ft., and will <br /> be under the allowed percentage to 24.40%.An existing lot that is 10,000 sq.ft.or under is allowed <br /> up to 25% lot structure coverage. <br /> 1 <br />
