Guard and Doc.: 1416026 <br /> Michele Guard, Trustees of the TM Ctf.: 224964 <br /> Guard Nominee Trust <br /> 409 Monomoscoy Road <br /> (Map 124 Parcel 62-0) <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 17, 2023 by Owners, Thomas and Michelle Guard, Trustees <br /> requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for removal of an <br /> existing shed, and construct a garage in its approximate location on property located in an R-3 <br /> Zoning District, at 409 Monomoscoy Road, Map 124 Parcel 62-0, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on March 3, 2023 and March 10, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, March 22, <br /> 2023 at which time the following members of the Board of Appeals were present; Chairman, <br /> Jonathan Furbush,Board Members,Ron Bonvie, Scott Goldstein,Norman J. Gould,and Associate <br /> Member,Brad Pittsley. Chairman Furbush opened the meeting,and heard testimony from Attorney <br /> Guard and Raul Lizardi-Rivera with Cape & Islands Engineering. The Chairman thereafter <br /> continued the hearing to April 26, 2023 to allow time for the applicant to provide a floor plan of <br /> the proposed garage and a revised site plan. The hearing was continued further until Wednesday, <br /> May 10, 2023 to allow the Board additional time for scheduling purposes. <br /> On May 10, 2023,the continued hearing was opened, at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman Jonathan Furbush, Board <br /> Members, Scott Goldstein, and Associate Members, Sharon Sangeleer, Charles Reidy, and Brad <br /> Pittsley. <br /> Attorney Steve Guard represented the Owners, Thomas and Michele Guard applicants for the <br /> Written Finding to allow for removal of an existing shed,and construct a garage in the approximate <br /> location. Also present was Raul Lizardi-Rivera with Cape & Islands Engineering, and Jeff <br /> Metcalfe, Architect. <br />
