MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Thomas J. Guard and Michele Guard Trustees <br /> 409 Monomoscoy Road, Map 124 Parcel 62-0 <br /> Mashpee, MA 02649 <br /> FINDING-2023-19 <br /> Attorney Guard mentioned that there will be an application submitted to apply for the accessory <br /> apartment. The Board of Health requested the existing floor plans and were submitted for their <br /> review. <br /> Chairman Furbush asked for the current amount of total bedrooms. Mr. Guard said there are <br /> currently a total of four bedrooms. <br /> Mr. Lizardi-Rivera said that there are three existing bedrooms in the main house on the second <br /> floor. The first floor has a den, and for the purpose of Title 5, it's a four bedroom house. The <br /> existing septic system is approved for five bedrooms. The loft counts as one additional bedroom, <br /> and will remain five bedrooms total. There are no changes being made in the main house. <br /> Mr. Goldstein noticed that the zoning table depicted 2.5 proposed stories. Mr. Lizardi-Rivera <br /> confirmed that it is two(2) stories. Mr. Goldstein wanted to confirm the amount of flood vents that <br /> will be installed. Mr. Lizardi-Rivera said that there are two on the rear of the structure, and there <br /> should be at least two located on two sides of the structure, but there are multiple vents. <br /> GENERAL FINDINGS <br /> The Board of Health comments dated May 9, 2023 were read into the record: "Protective sleeve <br /> of septic line is approved. Floor plans show 4 bedrooms in the main house and 1 bedroom above <br /> garage totaling 5 bedrooms. No Comment. " <br /> The Conservation Department comments dated May 8, 2023 were read into the record. "The <br /> Conservation Commission approved this project at their February 9rh public meeting and issued <br /> an order of conditions (permit). This project meets the performance standards for Regulation 25 <br /> (Land Subject to Coastal Storm Flowage)as the garage is going over previously existing driveway <br /> layout, thus no removal of native vegetation to accommodate. The shed relocation may involve <br /> removal of a couple of small saplings. " <br /> The Board read an email submitted to Zack Seabury, Board of Health Agent from Raul Lizardi- <br /> Rivera dated May 8,2023: "Attached is the floor plan the homeowner received when he purchased <br /> the property. There are three (3) bedrooms in the second floor, and one (1) den in the first floor. " <br /> There were no more comments from the Board or audience. <br /> The subject property located at 409 Monomoscoy Road contains a total of 14,983 square feet of <br /> land. <br /> There were no abutters present. <br /> 3 <br />
