Foster requesting a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze <br /> a pre-existing, non-conforming single-family structure and replace it with a new single-family <br /> structure on property located in an R-3 Zoning District(Little Neck Bay), at 31 Wheelhouse Lane, <br /> Map 120 Parcel 165, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on April 7, 2023 and April 14, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition request for a Special Permit at the Mashpee Town Hall <br /> on Wednesday,April 26, 2023 at which time the following members of the Board of Appeals were <br /> present and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, and Associate Members, Charles Reidy and Robert Caggiano. <br /> Attorney Christopher Kirrane represented the applicants for the raze and replace project. Also <br /> present was Tim Luff,with Archi-Tech Associates, and Raul Lizardi-Rivera with Cape & Islands <br /> Engineering. The existing dwelling has four bedrooms, and will be replaced with a four bedroom <br /> single-family dwelling under Section 174-17.1. The dwelling is located in the R-3 Zoning District, <br /> but it is subject to specific dimensional requirements because it is located in the Little Neck Bay <br /> subdivision. <br /> Attorney Kirrane stated that the existing structure is non-conforming in several aspects. The rear <br /> yard setback is 15.3 ft. which is a non-conforming condition based on the 20 ft. setback. The <br /> southerly side yard is 14.5 ft. and the proposed is 15.5 ft. <br /> 1 <br />
