MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT MODIFICATION (SP-2021-34) <br /> Petitioner, Pastore Excavation, Inc. <br /> Owner, Chapter Closed, LLC <br /> 40 Evergreen Circle, (Map 19 Parcel 10-4) <br /> Mashpee, MA 02649 <br /> SP-2023-28 <br /> Attorney Kirrane stated for the record there is one relief request for a 1 ft. variance from the front <br /> yard setback. There is a 70 ft. setback requirement from the front, but this building is setback <br /> further than the adjacent building, and the Board may find this de minimis because of the shape <br /> and typography of the lot on a cul-de-sack. <br /> The project was presented to the Design Review and Plan Review Committees on April 18, 2023, <br /> and was also reviewed by Mr.Ed Pesce, Pesce Engineering for a peer review. The Design Review <br /> Committee recommended that shutters be installed on the windows;the color scheme is slate gray <br /> for the building and the trim will be crimson red. The Design Review Committee also requested <br /> comments from Tyler Gaudreau, Associate Member who provided his landscape <br /> recommendations as follows: <br /> • Seed mixes for infiltration and rain garden area, type (no lawn mixes). <br /> • Evergreen tree recommendation—green giant arborvitae, shrub-inkberry). <br /> • Possible screening from abutting properties where applicable. <br /> The Plan Review Committee had several comments and recommendations listed below: <br /> • The size of the building on the plan depicts 7,500 sq. ft. but it is actually 7,475 sq. ft. <br /> (Plan needs to be revised). <br /> • Parking is preferred on the rear and side. (Requesting a waiver for the front) <br /> • Additional trees planted along the Easterly lot line. <br /> • Dumpster and Recycling Bin to be depicted on the site plan. <br /> • Perc Tests are required, and the plan should depict 1,000 gallon tank instead of 1,500 on <br /> Page 5 of 6. <br /> • Fire Dept. commented on the actual size of the building to confirm whether it would <br /> require a sprinkler system. (Needs confirmation). <br /> Mr. Dibb provided the following revisions that were made to the site plan, and revised comments, <br /> and are listed as follows: <br /> 1. A dumpster and recycling bin are now shown on the plan with a fence. <br /> 2. A perk test is required and will be performed on April 27th. The basis of the drainage <br /> design is for the contractors' yard but the new perks are being performed. <br /> 3. 1,000-gallon tank has been corrected on the plan. <br /> 4. Has the Fire department commented if a sprinkler system is required? Attorney Kirrane <br /> confirmed that the building size is 7,500 and does not require sprinkler system. <br /> 2 <br />
