Bk.: 33129 <br /> Owner, Chapter Closed, LLC Pg.: 293 <br /> 40 Evergreen Circle <br /> Map 19 Parcel 10-4 <br /> Mashpee,MA 02649 <br /> A Petition was filed on March 16, 2023 by Petitioner, Pastore Excavation, Inc. requesting a <br /> Variance from the front yard setback under §174-31 (Land Space Requirements) of the Zoning <br /> Bylaws to allow for construction of a metal commercial building with contractor bays on property <br /> located in the 1-1 and Light Industrial Overlay District(s), Map 19, Parcel 10-4, Mashpee, MA. <br /> (Owner of record: Chapter Closed, LLC). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee,on April 7,2023 and April 14,2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, April 26, <br /> 2023 at which time the following members of the Board of Appeals were present; Chairman, <br /> Jonathan Furbush, Vice Chairman, Bill Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, <br /> and Associate Member, Sharon Sangeleer. Chairman Furbush opened the meeting, and heard <br /> testimony from Attorney Christopher Kirrane, and Mark Dibb, Cape & Islands Engineering. The <br /> hearing was continued until May 10, 2023 to allow time for the Board members to acquire more <br /> specific information and comments from Mr. Pesce, Consulting Engineer, and other Town <br /> Departments. <br /> On Wednesday, May 10, 2023, the continued hearing was opened at which time the following <br /> members of the Board of Appeals were present and acting throughout; Chairman Jonathan <br /> Furbush, Board Member, Scott Goldstein, and Associate Board Members, George Ganzenmuller, <br /> Charles Reidy, and Robert Caggiano. <br /> Attorney Christopher Kirrane represented the Petitioner, Pastore Excavation, Inc for a <br /> Modification request to an existing Special Permit (SP-2021-34). Also present was Mark Dibb <br /> with Cape & Islands Engineering. This location was previously approved by the Board for a <br /> Contractor's yard, and the applicant is now seeking a Modification to construct a 7,500 sq. ft. <br /> Morton style metal building on this lot for contractor bays under the bylaws. <br /> 1 <br />
