� yuDSl�y�}j➢ �r °��� <br /> Town of Mashpee <br /> G � sr 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-2023-24 <br /> Owner, Quaker Run Nominee Trust, Bk.: 34610 <br /> Diane Wells, Trustee Pg.: 311 <br /> 28 Quaker Run Road <br /> Map 83 Parcel 19 <br /> Mashpee,MA 02649 <br /> A Petition was filed on March 15, 2023 by Owner, Quaker Run Nominee Trust, Diane Wells, <br /> Trustee requesting a Variance under §174-33 (Setback from wetlands) of the Zoning Bylaws to <br /> allow for construction of an access stairway to the dock on property located in an R-3 Zoning <br /> District, at 28 Quaker Run Road, Map 83 Parcel 19, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on April 7, 2023 and April 14, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, April 26, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, <br /> Ron Bonvie, Scott Goldstein, and Associate Member, Sharon Sangeleer. <br /> Attorney Christopher Kirrane represented the applicant for the Variance request under Section <br /> 174-33 Setback to wetlands. This is for an access stairway that will be attached to a dock, pier, <br /> ramp and float complex. Under the bylaws, the ramp and floating piers are exempt from Section <br /> 174-33, but the stairway is not exempt. The stairway has a 28 ft. slope from the top to the bottom <br /> of the coastal bank. The Conservation Commission issued an Order of Conditions and imposed <br /> conditions designed to protect the wetland resource area. The access stairs are designed to provide <br /> safe access to the dock and float complex without further degradation of the resource area, and <br /> will not result in a detriment to the Town or result in nullifying the bylaw. The house shown on <br /> the plan is not part of this application and does not require any relief from the Board. <br /> 1 <br />
