MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Owner, Quaker Run Nominee Trust <br /> Diane Wells, Trustee <br /> 28 Quaker Run Road, Map 83 Parcel 19 <br /> Mashpee, MA 02649 <br /> V-2023-24 <br /> SPECIFIC FINDINGS <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Variance from <br /> the wetlands setback.Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> April 26,2023,the Zoning Board of Appeals voted unanimously to issue a Variance for 28 Quaker <br /> Run Road to Owner, Quaker Run Nominee Trust, Diane Wells, Trustee under §174-33 (Setback <br /> from wetlands) of the Zoning Bylaws to allow for construction of an access stairway to the dock <br /> on property located in an R-3 Zoning District,Map 83 Parcel 19,Mashpee,MA with the following <br /> conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance under <br /> Mass General Law 40A Section 10. <br /> 2. Site plan — Prepared for: Quaker Run Nominee Trust, Diane Wells, Trustee, 28 Quaker <br /> Run Road, Mashpee, MA. Sheet No.: 1 of 1, Date: November 23, 2022, Drawn by: MD, <br /> Checked by: MC, Prepared by: Cape & Islands Engineering, Drawing Title: Site And Pier <br /> Plan. Stamped and signed by:Mark D.Dibb,Civil No.:45937,and Matthew C. Costa,No.: <br /> 52282. <br /> 3. The Zoning Board of Appeals issues a Variance under Section 174-33 (Setback from <br /> wetlands) in the amount of: 50 ft. For clarity, 50 ft. is required for the setback shown on <br /> the plan is zero, and the applicant requested a setback in the amount of 50 ft. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Conservation Commission comments. <br /> 3 <br />
