Ronhock requesting a <br /> Modification to an existing Special Permit (SP-2021-41) to remove condition line item(s) 8 and <br /> 10, and allow finished space at the Building Inspector's discretion,and allow finished space above <br /> a detached garage at Building Inspector's discretion on property located in an R-3 Zoning District, <br /> at 104 Degrass Road, Map 104 Parcel 18, Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on April 21, 2023 and April 28, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,May 10,2023 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Jonathan Furbush, Board Member, Scott Goldstein, and Associate Members, Sharon <br /> Sangeleer, Charles Reidy, and Robert Caggiano. <br /> Owners, Michael and Teresa Ronhock represented themselves for the Modification request. Ms. <br /> Ronhock addressed the Board asking to remove the restrictions that were placed on their deed that <br /> would restrict them from finishing the space and/or constructing an accessory apartment. <br /> The restrictions that were placed on the deed two years ago are preventing the homeowners from <br /> being able to finish their space, and also if they decide to construct an accessory apartment. They <br /> are requesting that any construction that they do on the property, or construct an accessory <br /> apartment be submitted to the Building Commissioner and the Health Agent. <br /> 1 <br />
