Town of Mashpee <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2023-30 <br /> Owner, 41 Waterline Drive, LLC Doc.: 1.475999 <br /> 41 Waterline Drive South Ctf.: 232242 <br /> Map 120 Parcel 149 <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 22, 2023 by Owner, 41 Waterline Drive, LLC requesting a Written <br /> Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of a deck <br /> addition on property located in the R-3 and Little Neck Bay Cluster Subdivision Zoning District(s), <br /> at 41 Waterline Drive South, Map 120 Parcel 149, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on April 21, 2023 and April 28, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hail on Wednesday,May 10,2023 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Jonathan Furbush, Board Member, Scott Goldstein, and Associate Members, Sharon <br /> Sangeleer, George Ganzenmuller, and Brad Pittsley. <br /> Attorney Christopher Kirrane represented the homeowners requesting a very modest 105 sq. ft. <br /> expansion to an existing deck located in the rear of the property that will bump out below the <br /> length of two windows as shown in a photo that was submitted to the Board. The project was <br /> approved by the Conservation Commission.The homeowners would like easier access and slightly <br /> more space on their existing deck.There are no proposed stairs on the deck extension.The structure <br /> is non-conforming as to the setbacks to wetlands, a side yard setback, and the front yard setback. <br /> The lot is entirely located within Land Subject To Coastal Storm Flowage (LSCSF) and is also <br /> non-conforming as to lot coverage. The deck will be approximately 35 ft. from the top of the <br /> boarding vegetative wetlands (BVW). The deck is raised off the ground and is not considered <br /> substantially more detrimental than what currently exists to the neighborhood. <br /> I <br />
