MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO SPECIAL PERMIT(S) <br /> (SP-83-3-008, SP-00-167, SP-02-59, SP-2020-06) <br /> Owner, 21 Frog Pond Close, LLC <br /> 21 Frog Pond Close (Map 90 Parcel 83) <br /> 352 Mashpee Neck Road (Map 90 Parcel 97) <br /> Mashpee, MA 02649 <br /> MOD-2023-32 <br /> 24. Applicant to install an IA septic system and tank will be rated at H2O. <br /> 25. No boat storage allowed on 352 Mashpee Neck Road from June lit to September 1" <br /> 26. Boats shall only be trailered,moved,repositioned, etc. on 352 Mashpee Neck Road during <br /> the hours of 8:00 am and 5:30 pm. <br /> 27. Only boats owned by existing slip customers may be stored on 352 Mashpee Neck Road. <br /> 28. No mechanical work to boats on 352 Mashpee Neck Road. <br /> 29. If the owner or future owners of 352 Mashpee Neck Road seeks to return the property to a <br /> residence only said owner may request the Zoning Board release the condition as to the <br /> limitations placed on the use of the residence and such condition shall be released on the <br /> stipulation that the lot be placed in separate ownership from 21 Frog Pond Close and the <br /> parking area be removed and returned to its pre-existing lot condition.Any deed restriction <br /> required should mirror this. <br /> 30. The Operation and Maintenance Plan (O&M) submitted to this Board shall be modified <br /> and submitted to this Board prior to the application of a Building Permit and included into <br /> this record. Page 2 of the O&M report shall read as follows: A properly operating drainage <br /> system is a basis for long life of the roads and parking area and for the protection of wetland <br /> resources against pollutants carried by storm water. If the drainage system fails to work, <br /> frequent pooling of storm water would be expected to occur on site possibly affecting the <br /> use and activities on the property. An Engineer, or a qualified individual shall be <br /> responsible for the maintenance and operation of the drainage system. <br /> 30. The recording of the amended O&M report, and modified Special Permit shall be required <br /> and submitted to this Board prior to an application request of a building permit. <br /> 31.No more slips than what exists today, and that number is one hundred fifty four(154). <br /> 32. The new lot located at 352 Mashpee Neck Road is for overflow parking only and shall <br /> only be utilized when the lower lot is completely full and said full lot will be seventy seven <br /> (77) cars. When a parking space becomes available in the lower lot, incoming cars must <br /> utilize the lower lot until said lot becomes full again. <br /> 8 <br />
