True Bk.: 32771 <br /> and Michael Woodcock Pg.: 222 <br /> 53 James Circle <br /> (Map 71 Parcel 43) <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 4,2023 by Owners,Cindy L.True and Michael Woodcock requesting <br /> a Written Finding under §174-17 of the Zoning Bylaws to allow for a second story addition(same <br /> footprint),to an existing single-family,pre-existing non-conforming dwelling on property located <br /> in an R5 Zoning District, at 53 James Circle, Map 71 Parcel 43, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on May 19,2023 and May 26, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,June 14,2023 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, Ron Bonvie, <br /> Scott Goldstein, and Associate Member, Brad Pittsley. <br /> Owner, Cindy True presented her Written Finding project request that includes a second story <br /> addition of an existing one story structure. She provided the Board with the proposed site plan <br /> and building plans. The proposed second story addition will be within the existing home that <br /> consists of the breeze way and garage. It will not exacerbate any pre-existing non-conformities <br /> or be any more detrimental to the neighborhood. The existing first story structure, basement and <br /> foundation walls will not be demolished in the process of this addition. The final result will be a <br /> two story, four bedroom home with a below grade basement detailed in the architectural plans, <br /> and detailed in the lower corner of the site plan. The current septic system is the original 3- <br /> bedroom system to the house, and will need to be replaced as part of the project. Coastal <br /> Engineering has already submitted permits for a new 4-bedroom I/A System which meets all <br /> setback requirements. <br /> 1 <br />
