MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 10,2024 <br /> Ms. Sangeleer read Evan Lehrer's recommendation comments dated January 5, 2024 into the record; <br /> "The Planning Department suggests that the proposed continuance, extension or alterations proposed <br /> would not be substantially more detrimental to the neighborhood than existedpreviously and that the <br /> Board can grant a written finding. Please be mindful of a potential lot coverage nonconformity and <br /> ensure, if it exists, that that nonconformity is considered in your deliberation and motions. " <br /> Mr. Bonvie asked for comments of building plans specifically the elevations. <br /> Mr.Morris stated that there are spot elevations on the plot plan. Mr. Morris stated that it's a lateral <br /> addition, and is not a substantial improvement and he could issue a building permit. He would just <br /> require an engineered stamped foundation plan. <br /> Mr. Reidy read Evan Lehrer's entire comments on this property into the record dated January 5, <br /> 2024. <br /> Mr. Bonvie asked if the audience had any comments. There were none. <br /> Mr. Blaisdell stated that the letter should be reissued, sent to Conservation for their opinion, and <br /> dated for their opinion. <br /> Mr. Bonvie asked the Board how they want to proceed. Mr. Bonvie further stated to the applicant; <br /> "How much of the existing building covers the lot indicating structure coverage; pre-existing and <br /> proposed. Lot coverage 100% existing, and 100% proposed if the entire lot is in the flood plain. <br /> Structure coverage which is 11.47% existing, and proposed structure coverage: 13.07%." <br /> The Board determined that the applicant should have his engineer revise the plans as follows: <br /> structure coverage, how much of the building covers the lot, pre-existing and proposed. Lot <br /> coverage will be 100%.And the plan should also depict the existing lot coverage,and the proposed <br /> lot coverage, if in fact the lot is entirely in the flood plain as stated in Mr. Doyle's letter that the <br /> entire lot is 100%in the flood plain. The plans should also depict: structure coverage which would <br /> indicate 11.47%, and proposed structure coverage as 13.07%. <br /> Mr. Reidy made a motion that the Board accept the applicant's request for an extension until <br /> Wednesday, March 13, 2024. Mr. Furbush second. All were in favor. <br /> 279 Monomosco Road: Owners,Patrick J. Dale and Rickart A. Connole,Trustees of the 366 CS <br /> Realty Trust request a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a <br /> pre-existing, nonconforming three bedroom dwelling, and replace it with a new three bedroom <br /> dwelling with a detached garage on property located in an R-3 Zoning District, Map 120, Parcel <br /> 37, Mashpee, MA. The existing property has the following pre-existing nonconformities: lot area, <br /> setback to water and wetlands, lot coverage and minimum side yard setback (southwesterly). The <br /> entirety of the subject lot is located in the flood zone. <br /> Sitting on this hearing are the four regular Board members and Mr. Reidy. <br /> 6 <br />
