Health Agent <br /> Chair Baumgaertel called the Board of Health meeting to order at 6:01 PM. Open session is <br /> open. s. Patel motioned to adjourn public session, open executive session, not to reopen <br /> public session, Motioned seconded by Brian 8aurngaertel. Roll call vote to enter executive session. <br /> Brian Baumgaertel (yes) Kripani Patel (yes) VOTE: Unanimous ( -0) <br /> EXECUTIVE SESSION: <br /> Discussion of Appeal of DEP Large Septic System Approval for 100 Great Neck Road North <br /> r Baumgaertel brought the Executive session to order at 6:02. <br /> r, Harrington commented that in regards to the appeal of DEP large septic system approval for <br /> 100 Great Neck Road North, there was a proposal and BSE brought in an expert, Winston <br /> Ste en from All Cape Environmental for possible scenarios to add denitrification tat e existing <br /> C designs reviewed and approved by DEP. He carve up with the layer cake system proposal. In <br /> the meantime DEP and town council had a hearing and both sides commented, DEP stated i <br /> hearing that the town doesn't have any right to make the appeal. Town council countered with <br /> BOH through nuisance laws and overseeing the environmental laws, said the town still has the <br /> right to base an appeal because we have the authority, If any mitigation is done it would help the <br /> environment. Attorney gave 60 days to complete mitigation, Mr. Harrington referred toe ails <br /> sent to the board which explained part of that. The town attorney felt that right nowt e taw <br /> doesn't have a strong position to press this matter and he doesn't believe that The Tow <br /> Managers Office will want to go through a lengthy process. Even if it gets beyond the 60 days, <br /> because after 60 days the attorney may say we really don't have any standing and throw it out. <br /> Then e get nothing. <br /> Juan arichal responded to his attorney, Rob Mills who forwarded the email to the Tow 's <br /> attorney who informed roue that there is this layer cake system out there which we can do. Sounds <br /> like Juan Marichal, the owner, is looking to do this and has let us know that. Mr. Harrington <br />
