WILLANDER: There was only one, but there were verbal conversation with him, I have them <br /> all documented going back to June of last year. <br /> MR. VIRGILIO : This was after it was discovered that the lock was broken? <br /> MR, HARRINGTON: The initial violation was for the leaking washing machine and water in the <br /> basement and the lock wasn't broken at that point so I got in, it was later when the plumber tried <br /> to go back that the lock was broken. We didn't actually cite it and send him the letter until March <br /> aft is year. That is why we put him under orders to fix the lock but we had discussions with him <br /> regarding the broken lock because access to the basement was still paramount to getting the <br /> plumbingfixed, It's just that we hadn't issued the order to get it fixed. <br /> MR. BAUMGAERTEL: Is the bulkhead the only means of entry into the basement? <br /> MR. HARRINGTON: It is. <br /> MS. WILLANDER: It was part and parcel to the repair so we sent the order letter immediately for <br /> the repair of the clogged pipe but in order for that repair to be made, he would have had to <br /> corrected it and there was an understanding on the phone that that was going to be corrected <br /> so that the repair to the clogged pipe could be done. <br /> MR. VIRGILIO : So where is the entry for the basement? <br /> MR. HARRINGTON: Only through the bulkhead, there is no entrance from the first floor into the <br /> basement. This is the only access and that has been the issue. <br /> MR.VIRGILIO :This is when I get confused, We have a building inspector;we have a fire inspector. <br /> Why are we not telling them that there may be a life safety problem there? <br /> MR. HARRINGTON: We also cited that access to the electrical panel was one of the issues. They <br /> were made aware oft at. We could issue all the orders we want but nothing has been complied <br /> with. So, if the other departments, had they been involved, wouldn't have gotten any response <br /> either. We were talking to owner and nothing got done. <br /> MR. BAUMGAERTEL: So prior to the March 11 letter was he made aware that the lock issue was <br /> also a sanitary code violation? So from March 11th is when he learned that the issue with the <br /> lock. <br /> MR. HARRINGTON: He was cited informally to repair the lock. <br /> MR. BAUMGAERTEL: Ok, so he was made aware of that. <br /> MR. HARRINGTON: There were other conversations with him that access was the issue. <br /> MS. WILLANDER: Part oft e delay is because that we were involving Building based on the fact <br /> that it was a violation of that residential code as well because of not having access to the electrical <br /> panel. So we were bringing in building we ended up having the code compliance person come <br /> out and do that subsequent inspection once we identified what the violation was within the <br /> residential code, <br /> R. BAUMGAERTEL: I understand that he isn't in the area and doesn't have means, but it's a <br /> bulkhead lock, We're not asking someone to put in a new means of egress. We are asking that a <br /> simple lock on a bulkhead door is repaired so that access to critical infrastructure to the building <br /> can be reached. <br /> MR. VIRGILIO : What about inspected? Reached and inspected. <br /> MR. BAUMGAERTEL: reached and inspected. <br /> MR. VI O : Is that correct Glen? <br /> MR. HARRINGTON: I don't know, it's 20 minutes to do it. <br /> MR. VIRGILIO : I can inspected of any violations after you get the door open. <br />
