Mr <br /> Borselli of Falmouth Engineering described the project along with Andrew Garulay of <br /> Yarmouthport Design Group. Patio and pool do not encroach closer than existing deck. <br /> Mike described pool dimensions and associated drainage structures. Property has existing <br /> I/A septic system. Mr. Garulay commented on pool depth and excavation details. No <br /> dewatering necessary from groundwater separation. Mrs. Clapprood asked about setback <br /> of proposed pool/patio. Agent clarified that existing deck is preexisting non-conforming <br /> structure. Additional discussion on fill and flood zone designation. Property is not within the <br /> velocity zone. Mr. Colombo asked about pool type, location of maintenance equipment <br /> location and drywell capacity and separation to groundwater. Mrs Zollo asked if a condition <br /> could be made to prohibit lawn fertilizer. Agent was unsure what type of lawn exists or if its <br /> fertilized currently. Public comment: Lynn Barbie (Surf Dr) inquired about pool fencing. <br /> Pool has automatic cover which negates requirement for fencing. Mr Cook clarified that <br /> associations cannot override building codes. Agent commented about mitigation credit and <br /> that there is none here. Mitigation will be required for any areas to be occupied by lawn in <br /> reduced patio footprint. <br /> Mrs. Zollo motioned for a close and issue with condition of mitigation and no <br /> fertilizers on the lawn, proof of zoning application and full pool drawdown to be <br /> done via tank truck. Mr. Dalton seconded the motion. Discussion ensued regarding <br /> a continuance vs issuance pending proof of ZBA application. Conditions reiterated <br /> on original motion. Fertilizer condition issue was brought up and discussed in <br /> regard to whether a restriction is something the commission can require. <br />
