to unforeseen circumstances. The applicant wishes to attend at the next BOH meeting. <br />Mr. Raposa sought clarification on the number of complaints and why this was the first <br />fine. Mr. Seabury noted that there have been several calls and emails to the applicant <br />regarding the violations. After due process notification, Mr. Seabury received an <br />additional complaint which caused a $500 fine to be issued. (A second offense would be <br />$1,000 and $5,000 for a third offense). Mr. Raposa thought the applicant should be <br />forced to pay the fine and questioned why this was the first fine if the applicant had <br />been in violation. Mr. Virgilio noted that the BOH has given some leeway on fines <br />previously and would like to see applicant appear before the BOH to express the <br />seriousness of the violation. Mr. Seabury stated if there is another violation the <br />applicant will be appearing to address a $1,000 fine. Mr. Livingston expressed <br />agreement on both views but wants to see the applicant to appear before the BOH. <br /> <br />Mr. Livingston made a motion to table the hearing until the next meeting which was <br />seconded by Mr. Raposa. <br /> <br />Roll Call Vote: John Livingston (Yes), Ed Raposa (Yes), Ernest Virgilio (Yes) 3 – 0 <br />unanimous. <br /> <br />Additional Topics: <br />None of the Members had any additional topics. <br /> <br />Health Agent Discussion: <br /> <br />The BOH will have a table set up at the National Night Out with free handbags for <br />children that were donated.
