The Board finds under §174-17 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood. <br /> Ms. Sangeleer, second. <br /> Mr. Blaisdell, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Reidy, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Written Finding. <br /> 10 Magnolia Lane: Owner, Paul Aries requests a Written Finding under §174-17 of the Zoning <br /> Bylaws to allow for construction of a 12.4 ft. x 12 ft. three season sunroom, and a front porch <br /> extension to a pre-existing, non-conforming structure on property located in an R-5 Zoning <br /> District, Map 27, Parcel 76, Mashpee, MA. <br /> Sitting on this hearing are Chairman Bonvie, Ms. Sangeleer, Mr. Blaisdell, Mr. Goldstein, and <br /> Mr. Ganzenmuller. <br /> Mr.Paul Aries,represented himself for the proposed three season porch in the rear of the property. <br /> The original site plan noted that the front porch as proposed, but is actually existing. There is no <br /> increase in the footprint of the porch area. The proposed three season porch is setback 11.9 ft. <br /> from the side property line and is less the 15 ft. requirement. Mr. Aries stated that he is not <br /> removing any trees. <br /> Mr. Morris confirmed that the applicant is not creating any new non-conformities. <br /> 5 <br />
