Town of Mashpee <br />16 Great Neck Road North <br />Mashpee, MA 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />DECEMBER 13, 2023 <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, December 13, 2023, <br />at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North. <br />Chairman, Ronald Bonvie, Board Members, Jonathan Furbush, Associate Members, George <br />Ganzenmuller, Charles Reidy, and Brad Pittsley were present. <br />Chairman Bonvie opened the meeting at 6:00 pm and announced that the hearings were being <br />televised live on Mashpee TV. He will take comments after each hearing. <br />CONTINUED HEARINGS <br />48 Greenwood Road: Petitioners. Joyce A. and Daniel Marsters request a Variance under §174- <br />31 of the Zoning Bylaws to allow for construction of retaining walls on property located in the R- <br />3 Zoning and Popponesset Overlay Districts, Map 117, Parcel 323, Mashpee, MA (Owner of <br />record: Joyce A. Marsters, as Trustee of the Greenwood Trust). (A letter received from the <br />Attorney dated November 30, 2023 requesting a withdrawal to be read into the record). <br />Mr. Reidy read a letter into the record dated November 30, 2023 from Attorney Kirrane <br />requesting a withdrawal without prejudice. Mr. Reidy moved that the applicant be permitted to <br />withdraw their request for a Variance without prejudice. Mr. Ganzenmuller second. All were in <br />favor. <br />42 Wheeler Road: Owner, Marcio DeJesus requests a Special Permit under § 174-17.1 and § 174- <br />33 of the Zoning Bylaws to raze an existing single family dwelling and replace it with a new single <br />family dwelling on property located in the R-5 Zoning District, Map 57, Parcel 7, Mashpee, MA. <br />(Continued from October 25, 2023; November 8, 2023 at the request of the Attorney). <br />Attorney Christopher Kirrane represented the applicant's request for a Special Permit to raze and <br />replace a single family dwelling. The lot is approximately 1.4 acres which is just under the 80,000 <br />sq. ft. requirement in the R-5 Zoning District which is considered non -conforming. The structure <br />that is being replaced has only one non -conforming aspect; it's within the 50 ft. setback to the <br />wetlands. <br />The existing lot coverage is 11.3%, the proposed lot coverage is 12.1% and is well under the 20% <br />requirement in the R-5 Zoning District. There are no flood zone issues, and there is no issue with <br />structure coverage. This project has been approved by the Conservation Commission. There will <br />be an IA System installed. The proposed structure will be moving slightly away from the wetlands. <br />There are no new non -conformities being created. There will be dry wells installed on the property <br />to capture any water runoff. <br />
