Town of Mashpee
16 Great Neck Road North
Mashpee, MA 02649
MASHPEE ZONING BOARD OF APPEALS
DECISION FOR A WRITTEN FINDING
FINDING-2023-40
Owners, Mark R. Galante and Bk.: 23997
Robin L. Galante Pg.: 334
164 Captains Row
Map 96 Parcel 28
Mashpee, MA 02649
A Petition was filed on June 2, 2023 by Owners, Mark R. and Robin L. Galante requesting a
Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for an addition,
alteration, extension to a pre-existing, non-conforming single family dwelling on property
located in an R-3 Zoning District, at 164 Captains Row,Map 96 Parcel 28, Mashpee,MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A.
Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation
in the Town of Mashpee, on June 16,2023 and June 23, 2023 a copy of which is attached hereto
and made a part hereof.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of
Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws.
Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, July 26,
2023 at which time the following members of the Board of Appeals were present and acting
throughout; Chairman, Ronald Bonvie, Scott Goldstein, Jonathan Furbush, Sharon Sangeleer,
and Associate Member, Charles Reidy.
Attorney Christopher Kirrane represented the applicants for a modest addition approximately 512
sq. ft. This project was originally submitted to the Board for a different application, but the
homeowners have now reduced the size of the addition and submitted a revised plan. There were
two comments submitted by the Board of Health that need to be addressed. The original addition
would have required a relocation of the septic system. The new addition does not require relocating
the septic system, however the note written on the plan mentions "relocation". The plan was
amended to remove that note because relocating the septic system is not necessary. The Board of
Health Agent sent an email that the septic system requires and inspection, but does not require any
permitting approval because there is no relocation necessary.
The original plan depicted an existing bedroom that was going to be relocated into the new
addition, however with the reduction in the size of the addition that bedroom is going to remain.
i
