MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO <br /> SPECIAL PERMIT(SP-86-04-024) <br /> Mashpee Commons Limited Partnership <br /> 38 Nathan Ellis Highway (Map 74 Parcel 20) <br /> (46 Market Street Building 31) Mashpee, MA 02649 <br /> SP-2023-41 <br /> Mr. Reidy wanted to make sure that the Board is in favor of the repurposing of this building, and <br /> based on receiving positive comments from the Town Planner. <br /> Mr. Furbush asked for a motion to close public comments. Ms. Sangeleer made a motion to close <br /> the public comments. Mr. Ganzenmuller seconded. All were in favor. <br /> In view of the foregoing, the Zoning Board of Appeals voted unanimously to grant Mashpee <br /> Commons Limited Partnership the request for a Modification to the existing Special Permit (SP- <br /> 86-04-024) to allow for re-purposing the second floor of an existing mixed-use building on <br /> property located in the C-1 Zoning District, Map 74 Parcel 20, at 46 Market Street, Building 31 <br /> Mashpee, MA. Upon motion duly made and seconded at the Public Hearings on Wednesday, July <br /> 12, 2023 with the following conditions: <br /> 1. The Board has determined that the applicant meets the conditions, and with discussion <br /> the members of the Board voting are unanimously in favor of this proposed use of the <br /> building. <br /> 2. Proposed Floor Plan: Building 31, at 46 Market Street, Mashpee, MA. Prepared by: Imai <br /> Keller Moor Architects, Project No: 22221, Drawn by: PC, CM, MS, Issue Date: July 11, <br /> 2023, Proposed I". Floor Plan, Proposed 2nd Floor Plan. <br /> 3. Referencing Mashpee Commons LP: Parking Demand, Parking Supply, and Wastewater <br /> Analysis Sheets (Special Permit Area) dated 7/7/2023. <br /> 4. Conditioned on all Town Department comments read into the record. <br /> 5. The Board finds that the re-purposing of the second floor of an existing mixed used <br /> building is an allowed use under the existing Special Permit (SP-86-04-024). <br /> 6. If the Community Health Center ends the proposed use of the building, and any change <br /> of use of the building will require the applicant to return to the Zoning Board of Appeals <br /> for further approval. <br /> 7. Conditioned on the Town Planner review and input to the Building Commissioner with <br /> positive comments to be submitted to the Zoning Board of Appeals. Received email dated <br /> July 13, 2023 from Evan Lehrer, Town Planner, "I highly encourage and recommend this <br /> modification as it meets a pressing need to provide alternative housing options to the community <br /> utilizing existing infrastructure and building footprints. It is my opinion that the dormitory style <br /> housing is an allowed use under the 1986 special permit and that the use would be a significant <br /> value add to the community. The Planning Department supports this proposal and is very happy <br /> that it was made by Mashpee Commons." <br /> 4 <br />
