MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Michael J. Degnan and Jennifer L. Degnan <br /> 23 Pembroke Drive (Map 123 Parcel 55) <br /> Mashpee, MA 02649 <br /> FINDING-2023-36 <br /> This project will not be substantially more detrimental than what currently exits or use to the <br /> neighborhood. The proposed lot coverage is 22.9% and is well below the requirement of 25%. <br /> Mr. Morris stated for the record in his opinion that this project is not creating any new non- <br /> conformities. <br /> The Board had a discussion and noticed that the site plan is dated November 2022, and does not <br /> depict if the lot is Land Subject to Coastal Storm Flowage (LSTCSF). The Board asked the <br /> applicant to provide confirmation from Cape & Islands Engineering regarding the lot coverage <br /> calculations. <br /> Chairman Bonvie explained to the applicant that if any area of the lot is within wetland jurisdiction <br /> or flood plain,than the computation will change. It has nothing to do with Conservation. <br /> Mr. Degnan asked if it has any bearing on whether it is significantly detrimental to the <br /> neighborhood. Mr. Furbush said; no. <br /> Mr. Bonvie polled the Board for their comments. <br /> Ms. Sangeleer asked for a condition that the mud room may not be winterized. Ms. Degnan said it <br /> will not be winterized. Mr. Degnan said that the front porch will be a screened porch, and will not <br /> be winterized. The mud room will just be enclosed and not heated. <br /> Mr. Morris said that the mud room is less than 70 sq. ft. Mr. Morris asked if the garage will have <br /> a deck above. Mr. Degnan said part of the deck is existing, and will be extending the deck 6 ft. to <br /> accommodate the width of a car. <br /> GENERAL FINDINGS <br /> The subject property located at 23 Pembroke Drive contains a total of 10,861 sq. ft. of land. The <br /> subject property is located within the Popponesset Overlay District. The minimum dimensional <br /> requirements in the Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 sq. ft. <br /> Minimum Front Yard Setback—25 ft. <br /> Minimum Side and Rear Yard Setbacks— 15 ft. <br /> Minimum Lot Coverage—25% <br /> The subject property is located on a corner lot, and one abutter questioned the setbacks from <br /> Uncatena Road. <br /> 2 <br />
