SEPTEMBER 13,2023 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> There are no setback to wetlands issues, and no flood zone issues. The only non-conformity is the <br /> 12 ft. setback from the ancient way between the exiting dwelling and the setback requirement is <br /> 40 ft. Otherwise, the structure complies with all other dimensional requirements. The proposal <br /> consists of a modest one and one-half story structure, three bedroom home and will include an <br /> installation of anew IA septic system.The lot coverage will increase from 14.56%to 16.99%which <br /> is well under the 25%requirement in the Popponesset Overlay District. <br /> Attorney Kirrane concluded that the redevelopment will not result in a condition that is <br /> substantially more detrimental than what currently exists, as follows: <br /> a. New construction will become building code compliant. <br /> b. A new IA septic system is being installed. <br /> c. There are no new non-conformities being created. <br /> d. The lot coverage will be under the maximum allowed 25%. <br /> e. Drywells are proposed to capture any water runoff onsite. <br /> f. The proposal is consistent with the redevelopment in the neighborhood. <br /> Mr. Reidy read the Board of Health comment dated September 7, 2023; "Storage" space on first <br /> floor must remain unfinished to not be considered a bedroom."Conservation Department comment <br /> was read into the record; "Property is not in Conservation jurisdiction. " <br /> Attorney Kirrane stated for the record that he spoke to the Health Agent. The plan was revised to <br /> depict the cased opening. <br /> Mr. Reidy read an email into the record dated September 13,2023 from John Molloy a resident of <br /> 196 Wading Place Road stating he is in favor of the project." <br /> Mr. Reidy stated he is glad to see that the IA system is being installed. <br /> Mr. Bonvie mentioned he is pleased to see that the proposed project is very modest. <br /> There were no comments from the audience, and no more comments from the Board. <br /> Mr. Morris had no comments. <br /> Mr. Bonvie asked for a motion to close the public comments. Mr. Reidy, so moved. Mr. Blaisdell, <br /> second. All were in favor. <br /> Mr.Reidy made a motion that the Board issue a Special Permit to Owners,Peter A.Frick and Tara <br /> L. Gildea under §174-17.1 of the Zoning Bylaws to raze and replace a pre-existing, non- <br /> conforming single family structure on property located in an R-3 and Popponesset Overlay <br /> District(s), Map 112 Parcel 49, Mashpee, MA with the following conditions: <br /> 6 <br />
