Atkins and John J.Weltman requesting <br /> a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of <br /> a garage, and additions on property located in an R-3 Zoning District, at 80 Punkhorn Point, Map <br /> 100 Parcel 4, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee,on August 11,2023 and August 18,2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, September <br /> 13, 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ron Bonvie, Board Member, William Blaisdell, and Associate Members, <br /> Charles Reidy, Bradford Pittsley, and Robert Caggiano. <br /> Attorney Christopher Kirrane represented the homeowners' application for a Written Finding to <br /> construct a three car detached garage, and an addition that is within the 50 ft. setback to the flood <br /> zone. Also present was Mark Dibb with Cape& Islands Engineering. The lot is located in the R-3 <br /> Zoning District, but the lot is only partially effected within the flood zone. The parcel is 32,571 <br /> sq. ft. that is deducted from the flood zone. The total upland area is 60,988 sq. ft. because the lot <br /> is not totally within the flood zone.As shown on the plan,the existing lot coverage (within 32,571 <br /> sq. ft.) is under the 20%requirement, at 15.4%. <br /> The lot coverage of the proposed additions will increase to 19.82% but is still less than the <br /> maximum allowed 20%requirement. The reason the garage and the addition are before the Board <br /> is that the projects are within the 50 ft. to the wetlands resource areas. There are no other setback <br /> non-conformities. The garage is not within Conservation's jurisdiction. <br /> 1 <br />
