DiGiusto, Trustees <br /> 108 Captains Row <br /> Map 96, Parcel 16 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 28, 2023 by Owners, Nicholas M. and Kathy DiGiusto, Trustees <br /> requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> replacement of an access timber stairway, and lower deck to dock on property located in an R-3 <br /> Zoning District, at 108 Captains Row, Map 96 Parcel 16, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee,on August 11,2023 and August 18, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, November <br /> 8, 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Acting Chair, Sharon Sangeleer, Board Members, William A. Blaisdell, Jonathan <br /> Furbush, Scott Goldstein, and Associate Member, Charles Reidy.Also Present was David Morris, <br /> Building Commissioner. <br /> Attorney Christopher Kirrane represented the homeowners for their request for a Written Finding <br /> under Zoning Bylaws §174-17 and §174-33 to replace the wooden stairway that leads down to an <br /> existing dock and float. Attorney Kirrane stated for the record that this project was continued by <br /> the Conservation Commission. However, he consulted with the Building Department and agreed <br /> that the project could move forward with the Board. There's no new additional structures being <br /> built; it's simply a replacement of the old stairway that will be building code compliant and will <br /> be beneficial to the resource area. <br /> 1 <br />
