MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, William P. Simmons and Roxanne M. Simmons <br /> 339 Monomoscoy Road, Map 120 Parcel 26 <br /> Mashpee, MA 02649 <br /> SP-2023-54 <br /> The lot structure coverage is 7.9%.The proposed project will consist of 16.66%lot coverage which <br /> is under the 20% maximum allowed lot coverage. The proposed meets the front yard, rear yard, <br /> and side yard setbacks. The new structure will meet all dimensional requirements and will not be <br /> creating any new non-conformities. The new structure will be setback further from the wetland <br /> resource area. There will be sufficient parking for the residence, and will be building code and <br /> flood zone compliant. The proposed structure will include a new IA septic system, and dry wells <br /> will be installed on the property. The proposed reconstruction was approved by the Conservation <br /> Commission, and is similar to other structures in the neighborhood that have been approved by the <br /> Board in the past. <br /> GENERAL FINDINGS <br /> The subject property located at 339 Monomoscoy Road has 54,100 square feet of land without. <br /> Land Subject To Coastal Storm Flowage (LSCSF) deduction. Lot coverage by structures consists <br /> of 34,100 sq. ft. <br /> There were no abutters present. <br /> Chairman Bonvie read comments into the record from Evan Lehrer, Town Planner and the <br /> Community Development Director that were received just before the meeting started. To <br /> summarize, Mr. Lehrer stated that the Board should review sections 174-17.1, and Section 174- <br /> 24.C.2 of the Zoning Bylaws in order to make a finding determination. <br /> The Board of Health comments dated October 24,2023 were read into the record; "New fast system <br /> approved for four (4) bedrooms in main house. " The Conservation Department comments dated <br /> October 25, 2023 were read into the record; "The only update Conservation has is for 339 <br /> Monomoscoy Road. The commission voted to close and issue the raze & replace for 339 <br /> Monomoscoy with conditions in a 4-2 vote. Landscape plans to be revised to include 2,812 square <br /> feet of mitigation in the 50'buffer zone per commission determination. <br /> Attorney Kirrane stated he listed the specific enhancements and proposed construction of the new <br /> dwelling in his written presentation that will be made to the lot. He stated that there has been <br /> substantial mitigation conditioned by the Conservation Commission. He stated that Conservation <br /> Department will be responsible for the revised landscape plan, but the project was closed and his <br /> understanding is an order of conditions was issued. <br /> Chairman Bonvie polled the Board for comments. Mr. Goldstein is satisfied with the placement of <br /> the house, is an improvement to the property, and is well under the lot coverage. <br /> 2 <br />
