Town of Mashpee <br />16 Great Neck Road North <br />MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A WRITTEN FINDING <br />FINDING-2023-57 <br />Owner, Gina Girard (f/k/a) <br />Gina Devlin <br />20 Oneida Avenue <br />Map 65 Parcel 48 <br />Mashpee, MA 02649 <br />Mashpee, MA 02649 <br />Doc: 748832 <br />Ctf.: 151185 <br />A Petition was filed on August 22, 2023 by Owner, Gina Girard (f/k/a Gina Devlin) requesting a <br />Written Finding under §174-17 of the Zoning Bylaws to allow for construction of a deck, and <br />garage with a porch addition, and extension to a pre-existing, non -conforming structure on <br />property located in an R-3 Zoning District, at 20 Oneida Avenue, Map 65, Parcel 48, Mashpee, <br />MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on September 22, 2023 and September 29, 2023 a copy of which is attached <br />hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, October 11, <br />2023 at which time the following members of the Board of Appeals were present and acting <br />throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br />Jonathan Furbush, and Scott Goldstein. <br />Attorney Christopher Kirrane represented the Ms. Girard who was also present. Ms. Girard is <br />requesting a Written Finding under Section 174-17 to add an addition and garage to a pre-existing <br />non -conforming structure. <br />The lot is oddly shaped consisting of 20,256 sq. ft., which is under the 40,000 sq. ft. requirement <br />making it non -conforming in the R-3 Zoning District. The structure itself is non -conforming in <br />two aspects. The existing house fronts on both Oneida at 22. 5 ft., and 8.7 ft. from Canonchet <br />Avenue where a setback of 40 ft. is required under the bylaw. The addition and garage will be built <br />on the Canonchet side in the rear part of the lot. There is an existing deck and patio which will be <br />cleared. <br />
