O'Connor <br />66 Massasoit Avenue <br />Map 72, Parcel 30 <br />Mashpee, MA 02649 <br />Mashpee, MA 02649 <br />Doc.: 1278853 <br />Ctf.: 207484 <br />A Petition was filed on September 8, 2023 by Owners, Patrick M. and Sharon M. O'Connor <br />requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for <br />construction of a second story addition, alteration, and extension to a pre-existing, non -conforming <br />structure on property located in an R-3 Zoning District, at 66 Massasoit Avenue, Map 72 Parcel <br />30, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on September 22, 2023 and September 29, 2023 a copy of which is attached <br />hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br />A Public Hearings was held on this Petition for a Written Finding at the Mashpee Town Hall on <br />Wednesday, October 11, 2023, at which time the following members of the Board of Appeals were <br />present and acting throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, <br />William Blaisdell, Jonathan Furbush, Scott Goldstein, and Associate Member, George <br />Ganzenmuller. <br />Attorney Christopher Kirrane represented the homeowners for their Written Finding request to <br />construct two additions. The lot size is 11,640 sq. ft. which is non -conforming in the R-3 Zoning <br />District. The lot is odd shaped and the dwelling fronts on both Massasoit Avenue and Sakonnet <br />Drive. The two non -conformities from the front yard setbacks are 3.3 ft. from Massasoit Avenue, <br />and 9.7 ft. from Sakonnet Drive. The current lot coverage is 16.9% which is conforming, and both <br />side yard setbacks are conforming. <br />Attorney Kirrane stated that the proposal consists of an addition on the Sakonnet Drive side of the <br />house will be 19.7 ft. from the property line which is further back than the existing non -conformity <br />of 9.7 ft. <br />
