Bettencourt Ctf.: DD/N <br /> 20 Bearse Rd <br /> Map 117 Parcel 322 <br /> Mashpee, MA 02649 <br /> A Petition was filed on September 18, 2023 by Owners, Paul K. and Kathleen A. Bettencourt <br /> requesting a Special Permit under§174-17.1 and §174-33 of the Zoning Bylaws to raze an existing <br /> single family dwelling and replace it with a new single family dwelling on property located in the <br /> R-3 and Popponesset Overlay Districts, Map 117, Parcel 322, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on September 29, 2023 October 6, 2023 and a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, October 25, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ron Bonvie, Board Members, Sharon Sangeleer, Jonathan Furbush, and <br /> Associate Members, George Ganzenmuller and Charles Reidy. <br /> Mr. Morris, Building Commissioner stated for the record that he received a Form 2 (A <br /> Conservation Department required application form) Mr. Morris signed the Form 2 and issued it <br /> on July 20, 2022 prior to a remand hearing for the Land Subject to Coastal Storm Flowage <br /> (LSTCSF)requirement that the Board now reviews. Mr. Morris did not realize that the application <br /> required Zoning. Mr. Morris revised the Form 2 and signed it on September 15,2023 and made an <br /> administrative decision, and advised the Board that the application required a Written Finding <br /> under §174-33, and that the existing home meets the setbacks and is conforming. He stated that <br /> the Board only requires to make a finding under §174-33. <br /> 1 <br />
