Mulgrew, Trustees <br /> of the 33 Sunset Circle Realty Trust requesting a Written Finding under §174-17 of the Zoning <br /> Bylaws to allow for reconstruction and extension of an existing deck to a pre-existing, <br /> nonconforming structure on property located in an R-5 Zoning District, at 33 Sunset Circle, Map <br /> 64 Parcel 28, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, November 10, 2023 and November 17, 2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on this Petition at the Mashpee Town Hall on Wednesday, December <br /> 13, 2023 at which time the following members of the Board of Appeals were present; Chairman, <br /> Ronald Bonvie, Board Members, Jonathan Furbush, Associate Members, George Ganzenmuller, <br /> Charles Reidy, and Brad Pittsley. <br /> Mr. Alex Lebedev, with Dream Home Improvement, Inc., represented Kevin and Suzanne <br /> Mulgrew for a Written Finding that includes reconstruction and extension of an existing deck that <br /> is in poor condition, and is unsafe. The existing deck is 10 ft. wide, and will be extended to 16 ft. <br /> by 16 ft.which is 6 ft.toward the wetlands. The Conservation Commission did approve the project. <br /> The existing sono tubes will remain and there will be two additional sono tubes. The lot coverage <br /> is 14.8% and well under the 20%. <br /> The Board was given a site plan of the existing and proposed conditions but the plan did not include <br /> the lot structure coverage utilizing land subject to Conservation jurisdiction, under Chapter 131, <br /> 40, and the lot structure coverage not utilizing Conservation jurisdiction. <br /> I <br />
