Giblin requests a Special Permit <br /> under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing, nonconforming <br /> residential structure, and replace it with a new single family residential structure with associated <br /> pool and detached garage with guest suite above on property located in an R-3 Zoning District, at <br /> 90 Popponesset Island Road, Map 106,Parcel 34, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee,on November 10,2023 and November 17,2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 24, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush,and Scott Goldstein. Also present was David Morris, Building Commissioner. <br /> Attorney Christopher Kirrane represented Mr. Brendon P. Giblin, the applicant for the Special <br /> Permit, seeking to allow the raze and replace of his house on 90 Popponesset Island Road. Also <br /> present was Mark Dibb, Engineer with Cape &Islands Engineering. <br /> Attorney Kirrane explained that this project consists of constructing a new code compliant single <br /> family structure, with an in-ground pool, and detached garage and guest suite above pursuant to <br /> Sections 174-17.1 and 174-33. The Board was given a site plan, house design plans, and a written <br /> narrative with photos of similar raze and replace redeveloped homes in the immediate <br /> neighborhood.The written narrative also included the Town of Mashpee Order of Conditions from <br /> the Conservation Commission, a letter from the (DEP) Department of Environmental Protection <br /> Agency, and a document titled; Findings Pursuant to MGL. C. 30 s. 61 to 62H, Inclusive, MEPA. <br /> 1 <br />
