Mr. Garulay representing Yarmouthport Design Group updates the commission with the following: the <br />attempt to recalculate the mitigation plan which has been proven to be unsuccessful at this time. He states a cord <br />and steel wall is being removed and will be replaced with native plantings on the slope for stabilization as well <br />as tree mitigation. A letter from the Fire Chief had requesting the width of the driveway to increase which has <br />been updated in the new plan. Removed the cobble board, the cutting of trees located outside the 150’ buffer <br />will be mitigated with new ones. The mitigation calculations were derived using current mitigation charts at the <br />time of filing the 18’ buffer of plantings full width of ground swell all across the buffer and the dwelling has <br />been elevated to not run into any vista issues. The vista corridor in the middle will have larger shrubs with <br />smaller shrubbery within the 50’ wide corridor on the landward side of the ground swell and all trees will <br />remain in this area. <br /> Mr. Borselli further states the submission of a nitrogen calculations to show the significant reduction of <br />nitrogen as part of the project. <br /> Commissioner’s comments/questions pertaining to the above information provided. <br /> Mr. Cook asks if there are any concerns of waves coming from the southwest section of the site as the <br />property slightly jets out to the bay. Mr. Borselli confirms there are no concerns regarding this matter as FEMA <br />models indicated minimal wave action in the upper reaches and the limit of moderate wave action located on the <br />far south and west section of the site supports his reasoning for no concerns regarding the southwest to northeast <br />sections. He further adds due to the directional aspect which would be lateral to the dwelling therefore, waves <br />would not be generated in that direction. Mr. Cook raises his concerns regarding the 10’ height of the wall and <br />the potential for a much higher wave during an extreme storm as well as the resiliency. Mr. Borselli ensures the <br />architects have considered these factors and are represented by adding doors and windows to the wall to help <br />with the water pressure. Mr. Cook’s final comment refers to the septic system placement being located on the <br />site across the street and what will be the remedy for the clearing of the area. Mr. Borselli states the red <br />markings found on the submitted plan represent the addition of natural native plantings. <br /> Ms. Godfrey has brought up the subject matter regarding the Flow Neutral Regulation and the septic system <br />being on a separate site. Mr. Colombo clarifies this concern is raised due to the bedroom count and lot size <br />ratio stated in the bylaws. Due to the lot size discrepancy between assessor’s records and the information given <br />makes it impossible to perform a proper analysis. In which Mr. Borselli offers to submit a revised plan which <br />will include in writing the total lot size for both Lot #17 and #20 which will include both uplands and wetlands. <br />The floor is now opened for public commentary. No in room comments. There was 1 mailed in letter submitted <br />by a resident within the community and was read out loud by Chairman Colombo. <br /> Mr. McManus supports the project as it is currently presented and requests the commissioners to consider the <br />totality of the project compared to what is currently built on the site and emphasizes the thorough data <br />collection from credible sources. He also concurs with Attorney Wall’s interpretation of vertical walls. <br /> Mr. Kent adds if there is a possibility for the limited work running along the ACEC to be brought closer to <br />the mitigations edge. Mr. Borselli agrees to the request with keeping a 5’ minimum separation from the <br />dwelling. <br /> Mr. Cook notes the outdated soil test log (March 11, 2016) which is over the 3 year limit. Mr. Borselli <br />suggests making a condition of performing another test. <br />Motion: Mr. Cook motions the closing of an issue at 17 Monomoscoy Road West, with the condition that a soil <br />test be provided at high tide at elevation 4 where the footing will be located, the condition for moving the limit <br />of work to the east side of the mitigation plantings and species swap out for the mitigation on the buffer, and the <br />condition of clarification of the total lot square footage which was seconded by Ms. Godfrey. <br />No discussion from commissioners. <br /> <br />Roll Call: Mr. Cook (Yes), Ms. Copeland (Yes), Ms. Godfrey (No), Mr. Colombo (No) <br />Motion does not pass. <br /> <br />ADDITIONAL CONVERSATION ENSUED WHICH RESULTED IN THE FOLLOWING. <br />Motion: Mr. Cook motions to close public hearing for 17 Monomoscoy Road West and deliberate with intent to <br />post decision during the April 4, 2024 hearing and will be in the discussion items section which was seconded <br />by Ms. Godfrey. <br /> <br />
