<br /> Resource Area: LSCSF (AE), buffer zone to bordering vegetated <br />wetland, saltmarsh, land under ocean & land containing shellfish. <br /> <br /> Mr. Colombo initiates the hearing by seeking clarification on the proceedings of the <br />prior meetings to ascertain the eligibility of the attendees for voting rights. Mr. Kent clarifies <br />that the two preceding meetings were continuations without any deliberations. Consequently, all <br />present members are entitled to vote in this session. <br /> <br /> Mr. Dib provides the Commission with comprehensive property details regarding the <br />subject area, covering aspects such as topography, nearby natural resources, and highlighting the <br />site’s location within a flood zone. He proposes the razing and replacing the existing dwelling <br />and boathouse. While the new dwelling will largely maintain its current footprint, there will be a <br />300sf increase to accommodate decking. Additionally, the applicant aims to swap the positions <br />of the new dwelling and the boathouse. Other elements of the proposal include a gravel <br />driveway, the installation of an I/A septic system and the construction of a patio. A critical aspect <br />involves moving the project further from natural resource areas and improving site drainage by <br />incorporating drain wells and mitigation measures. The proposal also includes a plan to enhance <br />the natural buffer along the waterfront and replace twelve cut trees. <br /> <br /> During Mr. Dibs presentation he emphasizes his reasoning for the inapplicability of <br />Regulation 25, citing the subject’s location and arguing that the intention of the regulation was <br />not to apply to land subject to coastal flow. He provides supporting documentation from the State <br />of Rhode Island Chapter 140, the Mashpee Wetlands Regulation, and from the creator of the <br />regulation itself, Mr. Sherman. In conclusion, the waiver was not submitted due to their <br />interpretation of Regulation 25. <br /> <br />*Please be aware that Mr. Dib is representing multiple hearings tonight, including those for 14 <br />Capstan Circle, 58 Bearse Road and 48 Greenwood Road. He has provided the same reasoning <br />for not applying for a waiver regarding Regulation 25 for all additional hearings. Additionally, <br />please refer to pages 19-21 of the minutes for Regulation information and a copy of the CZM <br />map. <br /> <br /> Mr. McManus inquires about the project’s impact on the floodplain. Mr. Dib responds <br />that with the natural mitigation buffer outlined in the proposal, the new dwelling will meet flood <br />compliance standards, including the installation of flood vents. Additionally, there will be an <br />overall net increase of 18,000cuft in flood storage capacity. Mr. McManus further requests an <br />update to the mitigation plan to adhere to the new 2:1 ratio requirements. <br /> <br /> <br /> <br />COMMISSIONERS COMMENTS <br /> <br /> Mr. Colombo acknowledges the attorney’s letter along with Mr. Sherman’s affidavit. He <br />mentions thoroughly reviewing the State of Rhode Island, Costal Management Program, Section <br />140 (pg. 21), noting its resemblance to Regulation 25 C7C, albeit with the omission of references <br />3 <br /> <br /> <br />
