• Recommendation: Approval should be granted due to the Wastewater
Superintendent's letter, with the condition that if any changes occur in
the sewer phases and the road is removed from the list, the homeowner
must upgrade to an I/A system capable of compensating for 10
milligrams per liter or less.
COMMISSIONERS COMMENT
Clarification on the required lot size and whether an upgrade would necessitate 1
bedroom?
The property is 13000 sqft, and with an I/A system, it can accommodate 2
bedrooms, but the homeowner would need to locate the nitrogen agrigation land.
The land parcel would need to make up for 23000 sqft or find 30000 sqft of
agrigated land.
The Chairman has expressed concern about projects within the 2-year timeframe.
However, with the approval of the Wastewater Superintendent, he is supportive of
the project.
The Board has confirmed with the Agent that the homeowners are aware of the
contingencies that will be implemented.
The Agent has confirmed that he has communicated with the homeowner to
ensure they understand the contingencies.
Motion made by Mr. Livingston to grant the variances from the Title 5 zone 2
regulation to allow 4 bedrooms on the property without the aggregate land or I/A system
and to grant the variance from the local 1000 ft regulation requiring an I/A system
because of sewer hookup with the stipulation if the sewer phases change and the road is
taken off the list the homeowner must upgrade to an I/A system that decreasing down to
10 milligrams per liter or less and gets aggregate land or removes compensate for 10
milligrams per liter or less of nitrogen or removes pollutants. Motion seconded by Mr.
Raposa.
PUBLIC COMMENT
There is no public comment.
• Roll Call: Mr. Livingston (Yes), Mr. Raposa(Yes), Mr. Vigilio
(Yes).
Motion passed unanimously.
Documents provided: Public hearing/variance request form, application #VAR-24-122288
3
