Marino <br /> 14 Ashumet Avenue, (Map 49 Parcel 104) <br /> Mashpee, MA 02649 <br /> FINDING-2024-03 <br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a Written Finding. <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, February 14, 2024, <br /> the Zoning Board of Appeals voted unanimously to issue a Written Finding under §174-17 of the <br /> Zoning Bylaws to Owner, Joseph T. Marino, at 14 Ashumet Avenue, to allow for construction of <br /> a dormer over an existing garage, and a deck addition to a pre-existing non-conforming structure <br /> on property located in an R-5 Zoning District, Map 49, Parcel 104, Mashpee, MA with the <br /> following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Plot Plan — 14 Ashumet Avenue, Mashpee, MA. Prepared for: Joseph Marino, Prepared <br /> by: All Cape Septic and Survey, Date: August 19, 2023, Revised: October 28, 2023, and <br /> December 9, 2023. Conditioned on all Town Department comments read into the record including but not <br /> limited to the DPW,Board of Health,and Building Department. comments. Final approval <br /> to be obtained by the Department of Public Works in referencing the water to be captured <br /> onsite. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> a <br /> 6. The Board finds that the proposed project under §174-17 of the Zoning Bylaws is not <br /> substantially more detrimental than the pre-existing, non-conforming structure or use to <br /> either the Town or the neighborhood, and that there is adequate land area to provide <br /> sufficient parking as may be required. <br /> 4 <br />
