Funk and Bk.: 23678 <br /> Donna M. Funk Pg.: 20 <br /> 5 Sheffield Place <br /> Map 29, Parcel 150 <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 3, 2023 by Owners, Christopher P. Funk and Donna M. Funk <br /> requesting a Variance under §174-31 of the Zoning Bylaws to allow for construction of a 200 sq. <br /> ft. shed on property located in an R-5 Zoning District, Map 29, Parcel 150, Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee,on December 15, 2023 and December 22,2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, January 10, <br /> 2024, and continued to February 14, 2024 at the request of the applicant. The following members <br /> of the Board of Appeals were present and acting throughout; Chairman, Ronald Bonvie, Board <br /> Members, Sharon Sangeleer, William A. Blaisdell, Jonathan Furbush, and Scott Goldstein. <br /> Attorney Christopher Kirrane represented the homeowners for their Variance request to vary the <br /> side yard lot line of an existing 200 sq. ft. shed 11 ft. from the property line. This application was <br /> before the Board back in December, 2022 for the same request. At that time, the homeowners <br /> provided a site plan that depicted two sheds on the property, the 200 sq. ft. shed, and a smaller <br /> shed situated in the rear on Town property. At that time, the Board had a discussion with the <br /> homeowners to move the smaller shed 5 ft. off the rear property line, and provide a revised site <br /> plan depicting the corrections made to the property. The homeowners re-applied to the Board,and <br /> are now requesting a 4 ft. variance for the 200 sq. ft. shed. <br /> Attorney Kirrane explained that the homeowners have complied with the Board's requests from <br /> the previous hearing, and believes a Variance is warranted. The neighbor who would be most <br /> affected by this variance request provided a letter, and has no objections to the placement of the <br /> shed. <br /> 1 <br />
