Ilin requests a Written Finding under <br /> §174-17 and §174-33 of the Zoning Bylaws to allow for a 360 sq. ft. addition to a pre-existing, <br /> nonconforming structure on property located in an R-3 Zoning District,at 18 Neshobe Road,Map <br /> 125, Parcel 105, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee,on December 15, 2023 and December 22,2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 10, <br /> 2024, and was continued to allow the applicant enough time to provide the Board with <br /> supplemental information to be added on the site plan by the surveyor. <br /> A Public Hearing was held on March 13, 2024 at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Ronald Bonvie, Board Members, <br /> Sharon Sangeleer,William A. Blaisdell, Jonathan Furbush, and Scott Goldstein. Also present was <br /> David Morris, Building Commissioner. <br /> Mr. Ilya Ilin represented himself for the proposed project. He is the owner of the property and <br /> would like to extend the living area of the existing dwelling. He stated that the surveyor indicated <br /> that the whole lot is entirely in the flood zone which is 100% lot coverage. The plan depicts the <br /> existing lot coverage of 11.47%, and proposed is 13.07%. The new construction will be built on a <br /> poured foundation. <br /> The Board reviewed the site plan and determined that the pertinent information was depicted on <br /> the revised site plan. The Board also requested clarification from the comments submitted from <br /> the Conservation Agent that were read into the record at the January 10, 2024 hearings. <br /> I <br />
