Selewacz Irrevocable Family Trust <br /> 70 Alma Road (Map 117, Parcel 161) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 4, 2023 by Petitioners, Patrick and Julie McNamara requesting <br /> a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing, <br /> nonconforming single-family structure and replace it with a new single-family structure on <br /> property located in an R-3 Zoning District and the Popponesset Overlay District,at 70 Alma Road, <br /> Map 117 Parcel 161, Mashpee, MA. (Owners of record: Harry F. Selewacz and Marilyn T. <br /> Selewacz Irrevocable Family Trust). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on January 19, 2024 and January 26, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9and the Town of Mashpee Zoning By-laws. <br /> The Petition was opened and extended by written agreement between the applicant and the Board <br /> of Appeals. A copy of the written agreements are filed with the Town Clerk; March 13, 2024, <br /> March 27, 2024, and April 24, 2024. <br /> A Public Hearing was held on the Special Permit request at the Mashpee Town Hall on <br /> Wednesday, May 22, 2024 at which time the following members of the Board of Appeals were <br /> present and acting throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, <br /> Jonathan Furbush, and Associate Member, George Ganzenmuller. <br /> Attorney Christopher Kirrane represented the Petitioners for this project. The project consists of a <br /> raze and replace of a non-conforming structure under§174-17.1 and §174-33.The house is located <br /> in the Popponesset Overlay District that requires a minimum lot size of 6,000 sq. ft., frontage of <br /> 60 ft., a front setback of 25 ft., and the rear and side setbacks are 15 ft. This particular lot requires <br /> a 50 ft. setback to wetlands. <br /> i <br />
