MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Petitioners, Patrick McNamara and Julie McNamara <br /> Owners of Record: Harry F. Selewacz and <br /> Marilyn T. Selewacz Irrevocable Family Trust <br /> 70 Alma Road (Map 117, Parcel 161) <br /> Mashpee, MA 02649 <br /> SP-2024-06 <br /> Proposed is 25.6 ft. Rear Yard Setback: 37.9 ft., Proposed is 21.3 ft. Side Yard Setback: <br /> northerly—7.4 ft., southerly 25.1 ft. Proposed northerly is: 13.2 ft., southerly is 15.5 ft. <br /> • The new dwelling will comply with current flood zone and building code requirements. <br /> • There will be a new I/A septic system installed. <br /> • Two sheds are being removed. <br /> • Drywells are being installed. <br /> • There is no increase in bedrooms. <br /> • The project was approved by the Conservation Commission. <br /> • There are no new non-conformities being created. <br /> • The overall coverage of structures as it relates to total lot area is proposed at 25%. <br /> • The proposed dwelling is similar to other redevelopment in the neighborhood. <br /> • There is sufficient parking as required. <br /> The Board determined the Petitioner met the criteria for a Special Permit.Upon motion duly made <br /> and seconded at the Public Hearings on Wednesday, May 22, 2024 the Zoning Board of Appeals <br /> voted 4-0 to issue a Special Permit to Petitioners, Patrick and Julie McNamara for 70 Alma Road <br /> under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing,nonconforming single- <br /> family structure and replace it with a new single-family structure on property located in an R-3 <br /> Zoning District, and the Popponesset Overlay District, at 70 Alma Road, Map 117 Parcel 161, <br /> Mashpee,MA. (Owners of record: Harry F. Selewacz and Marilyn T. Selewacz Irrevocable Family <br /> Trust) with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan—Prepared for: Patrick and Julie McNamara, Project: 70 Alma Road, Mashpee, <br /> MA. Sheet No.: 1 of 1, Date: March 28, 2024, Prepared by: Cape & Islands Engineering, <br /> Stamped and signed by: Mark Dibb, and Matthew C. Costa. <br /> 3. Building Plans — McNamara Residence, 70 Alma Rd. Sheet No.: 1 - First Floor Plan, <br /> Second Floor Plan, Sheet No. 2: Front Elevation, Right Elevation.
