White and Doc.: 1386845 <br /> Lisa White Ctf.: 221490 <br /> 425 Monomoscoy Road <br /> Map 124, Parcel 55 <br /> Mashpee,MA 02649 <br /> A Petition was filed on February 5,2024 by Owners, Mark H. and Lisa White requesting a Special <br /> Permit under§174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing,non-conforming <br /> single-family structure, and replace it with a new single-family structure on property located in an <br /> R-3 Zoning District, at 425 Monomoscoy Road, Map 124,Parcel 55,Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on February 16, 2024 and February 23, 2024. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> The Petition was opened and extended by written agreement between the applicant and the Board <br /> of Appeals. A copy of the written agreements are filed with the Town Clerk; March 13, 2024, <br /> March 27, 2024, and April 24, 2024. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, May 22, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, Jonathan Furbush, <br /> Scott Goldstein, and Associate Member, George Ganzenmuller. <br /> Attorney Christopher Kirrane represented the homeowners for this petition requesting a <br /> continuance for the purpose that the project was denied by the Conservation Commission, and he <br /> anticipated that his client would be submitting a revised application to the Conservation <br /> Commission. <br /> The Board had a discussion and agreed that the best practice would be to withdraw the Petition <br /> because it was not clear what the time frame would be of the revised plans, and application for the <br /> Zoning Board hearings. Attorney Kirrane requested a withdrawal of the Petition without prejudice. <br /> A motion was made to accept Attorney Kirrane's request to withdraw the Petition without <br /> prejudice for Owners Mark H. and Lisa White, at 425 Monomoscoy Road. <br /> 1 <br />
