McDonald, Jr. and Tracy A. <br /> McDonald request a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze a <br /> pre-existing,nonconforming three bedroom single-family dwelling,and replace it with a new three <br /> bedroom single-family dwelling on property located in an R-3 Zoning District, Map 111, Parcel <br /> 11, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation i <br /> the Town of Mashpee, on February 16, 2024 and February 23, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee ZoningBy-laws. <br /> The Petition was opened and. extended by written agreement between the applicant and the Board <br /> of Appeals. A copy of the written agreements are filed with the Town Clerk; March 13, 2024, <br /> March 27, 2024, and April 24, 2024. <br /> A Public Hearing was held on the Special Permit request at the Mashpee Town Hall on <br /> Wednesday, May 22, 2024 at which time the following members of the Board of Appeals were <br /> present and actingthroughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, <br /> Jonathan Furbush, and Associate Member, George Ganzenmuller. <br /> Attorney Christopher Kirrane represented the homeowners requesting a Special Permit under <br /> §174-17.1 to raze and replace an existing single family residential structure, and replace it with a <br /> new single-family structure, inclusive of a spa with storage, a rinse station, deck and shed located <br /> at 14 Capstan Circle. The lot area requirement in the R-3 Zoning District is 40,000 s . ft., the <br /> frontage requirement is 150 ft., the front yard setback is 40 ft., the rear and side yard setbacks are <br /> 15 ft., and the maximum lot coverage allowed is 20%. There is also a 50 ft. setback to the wetlands <br /> under §174-33 oft e Zoning Bylaws. <br /> 1 <br />
