Finance Committee <br />Minutes <br />August 29, 2024 <br /> <br /> <br />NEW BUSINESS <br /> <br />1. Town Manager Updates. <br />Mr. Collins updated the Committee on Draft #4 of the Town Meeting Warrant stating that he received the email <br />from Chair Schuh requesting a status update on Articles #5 and #6 of Draft #3 of the Town Meeting Warrant. He <br />said that he believes the Committee is aware that those Articles have been removed and that his <br />recommendation was to go with Contracted Services. He stated that Articles #7, #8, #9 and #10 of Draft #3 of <br />the Town Meeting Warrant are now Articles #4, #5, #6 and #7 on Draft #4 of the Town Meeting Warrant. <br />Mr. Collins stated that Article #4 of Draft #4 of the Town Meeting Warrant requesting $80,000 is not requesting <br />any funding and is coming from existing funds to be repurposed from $195,000 originally appropriated at the <br />May 2024 Town Meeting. <br />Mr. Collins said that his recommendation at the next Select Board meeting will be to pull Article #5 of Draft #4 of <br />the Town Meeting Warrant. He stated that his reason is because there are ARPA and Federal funds that can <br />cover the cost and that only a Select Board approval is needed, not a Town Meeting vote. He stated that he <br />wants to make it clear that he will be going for the specific amount of $150,000. <br />He went on to state that his recommendation for Article #6 of Draft #4 of the Town Meeting Warrant will be the <br />same as his recommendation for Article #5 for the same reason. It was stated that there is currently $183,000 in <br />mitigation funds that will cover the cost $45,000 requested for this. <br />It will be recommended that Article #7 of Draft #4 of the Town Meeting Warrant be pulled as mitigation funds <br />will be used to cover the cost $75,000. <br />Mr. Collins said that they don’t want to get into the practice of utilizing Free Cash at October Town Meeting as <br />the Charter suggests that the May Town Meeting focus on financial purposes and October Town Meeting be <br />primarily concerned with non-financial matters. Additionally, there isn’t any certifiable amount available for <br />Free Cash at this time. <br />It was stated that the Town Manager can’t comment on the CPC Articles. It will be his recommendation to pull <br />Article #7 of Draft #4 of the Town Meeting Warrant. <br />Mr. McKelvey inquired as to whether a full time Town Planner has been hired yet and Mr. Collin responded that <br />there has not been. Mr. Collins said that they currently have a consultant that works 3 days per week. <br /> <br />2. Discuss Draft Warrant. <br /> <br />A motion was made by Jeffrey Pettengill to remove the HOLD on Article #3 of Draft #4 of the Town Meeting <br />Warrant. <br />Motion seconded by Greg McKelvey. <br /> <br />Matthew Haney explained that Article #3 is a combination between the CPC and the Conservation. <br />He stated that back in 2011 there was an Article submitted but, that there was litigation and it wasn’t <br />appropriate at the time. Litigation is now over and they have direction from the First Circuit directing them to <br />proceed with the development of the property by getting decisions from the Town as to whether they want to <br />allow development of the property. If the Town doesn’t agree with development then he can go back to the <br />First Circuit for a Regulatory Taking. Matt stated that the Town can’t issue permits because they would be in <br />violation with the IGA and the Mashpee Wompanoag Tribe. <br />In summary, it was stated that the Town will get an appraisal, Matt said he has a dollar amount that he has to <br />get and he’s confident the appraisal is going to come back close to the dollar amount. He’s proposing that the <br />Town uses some CPC funds and the remaining amount be allocated over time to purchase the parcel. <br />2 <br /> <br /> <br />
