o The Commission does not supersede the building code; they are separate and
distinct bodies of law. A property owner must comply with the zoning, building
code, planning board, permitting, board of health, and conservation commission.
However, this is supplemental to the building code requirement. If the proposed
project complies with the building code, that doesn’t mean it will comply or be
okay under the Wetland Protection Act.
o A final decision does not need to be made today, and the Commission can
reconvene within 90 days.
Questions and Answers
o Q: If this case is sent back to the Commission, would it impact the existing
superseding order of conditions?
A: The superseding order would remain in effect, and any Commission action must
comply with the bylaw regulation.

Motion made to adjourn the Executive Session by Mr. Cook.
