o The Commission does not supersede the building code; they are separate and <br />distinct bodies of law. A property owner must comply with the zoning, building <br />code, planning board, permitting, board of health, and conservation commission. <br />However, this is supplemental to the building code requirement. If the proposed <br />project complies with the building code, that doesn’t mean it will comply or be <br />okay under the Wetland Protection Act. <br />o A final decision does not need to be made today, and the Commission can <br />reconvene within 90 days. <br />Questions and Answers <br />o Q: If this case is sent back to the Commission, would it impact the existing <br />superseding order of conditions? <br />A: The superseding order would remain in effect, and any Commission action must <br />comply with the bylaw regulation. <br /> <br /> <br />Motion made to adjourn the Executive Session by Mr. Cook.
