MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 28, 2024 <br /> The Board members agreed that this application should be withdrawn because it is two separate <br /> proposals. <br /> Attorney Johnston requested a withdrawal without prejudice and will submit two separate <br /> applications to the Building Commissioner. <br /> Ms. Sangeleer stated that the portion located in the C-2 requires a Special Permit with the Planning <br /> Board. <br /> Attorney Johnston stated that is correct if NextGrid decides to keep the medium-large scale solar <br /> in the C-2,the building inspector would deny that, and an appeal would be submitted to the Zoning <br /> Board. <br /> Mr. Furbush stated that a correct submittal would be appropriate. <br /> Mr. Morris stated that if the application includes the "Dover Amendment", he believes that the <br /> Zoning Board does not have the authority to interpret the Dover Amendment because it is not in <br /> the bylaws. <br /> Mr. Reidy made a motion that the Board accept the formal withdrawal request by Attorney <br /> Johnston, and Daniel Serber regarding the 420 Nathan Ellis Highway medium-larger-scale solar <br /> appeal without prejudice. Mr. Furbush second. All were in favor. <br /> OTHER BUSINESS <br /> -Approve August 14, 2024 Meeting Minutes. <br /> Mr. Sangeleer made a motion to approve the August 14,2024 meeting minutes.Mr.Furbush second. <br /> All were in favor. <br /> -Marius Dehelean-Interview,discussion,and recommendation for Zoning Board appointment. <br /> The Board asked the applicant if he would be able to attend the meetings on a regular basis. Mr. <br /> Dehelean said; yes. <br /> Mr. Dehelean discussed his employment qualifications and experience with zoning bylaws, and <br /> M.G.L. 40A and 40B. <br /> The Board asked Mr. Dehelean several questions about the applications that were before the Board <br /> prior to his interview. He agreed that the applicants need to follow the correct protocol. <br /> The Board completed the interview and filled out their forms to be submitted to the Select Board. <br /> 12 <br />
