MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 28, 2024 <br /> Chairman Bonvie questioned the drainage calculations with Mr. Bunker and asked him if he <br /> considered any offsite computation under"Item A: total watershed area in acres."Mr. Bunker said; <br /> "No". Mr. Bonvie asked if there is any offsite water/drainage moving toward the lot. Mr. Bunker <br /> said that the back of the lot has a retaining wall. <br /> Chairman Bonvie and some of the Board members had a lengthy discussion and still have concerns <br /> with the drainage. Mr. Reidy would like the information revised and noted on a site plan. Mr. <br /> Furbush thought that the drainage concerns should only pertain to this lot. <br /> Mr. Morris asked Mr. Bunker if he established the height measurements of the house from the <br /> original average grade. Mr. Bunker said; "Yes". <br /> Attorney Kirrane listed all the positive upgrades to the new construction, and is certain they will <br /> be established under the Special Permit criteria. <br /> Mr. Furbush and Mr. Blaisdell believe that the water/drainage issues discussed during the meeting <br /> should not be the Board's concern. <br /> Chairman Bonvie,Mr. Caggiano, Mr. Reidy, and Mr. Milbury would like the engineering drainage <br /> calculations for the abutting lots. <br /> Attorney Kirrane asked the Board for an extension until Wednesday, September 11, 2024. Mr. <br /> Reidy made a motion to continue the hearing. Ms. Sangeleer, second. All were in favor. <br /> NEW HEARINGS <br /> 53 Greenwood Road: Owners, Brian and Elizabeth L. Rutana, Trustees request a Special Permit <br /> under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing, nonconforming <br /> structure, and replace it with a new single-family structure on property located in in the R-3 and <br /> Popponesset Overlay District(s), Map 117, Parcel 343, Mashpee, MA. <br /> Sitting on this hearing are the four regular Board members and Robert Caggiano. <br /> Attorney Christopher Kirrane represented the homeowners requesting a Special Permit for 53 <br /> Greenwood Road. This property is located in the Popponesset Overlay District and has specific <br /> setback dimensions. <br /> There are several non-conformities on this lot. For zoning purposes the lot is only 821 sq. ft. due <br /> to the presence of flood zone and subject to coastal storm flowage. It does not meet the 50 ft. <br /> setback to wetlands. There is 100% lot coverage because 99% of the lot is located in the flood <br /> zone. The front yard setback to Shore Drive is nonconforming at 24.4 ft. The rear yard setback to <br /> Shore Drive is nonconforming at 3.5 ft. The rear yard setback to Greenwood Road is <br /> nonconforming at 1.7 ft. <br /> 4 <br />
